Terms of Service

Rules for authorized use of the Munchello Commerce Control private beta.

1. Service and eligibility

These Terms govern access to Munchello Commerce Control, an invitation-only Amazon advertising operations and seller analytics service operated by Munchello LLC. The service is available only to approved businesses and their authorized administrators. It is not currently offered as a public subscription.

2. Authority and Amazon accounts

By connecting an account, you represent that you are authorized to act for the applicable legal entity and to grant the requested Amazon permissions. Each connected legal entity must use its own approved administrator, authorization grant, and data boundary. You must not connect an account you do not control or attempt to access another business’s data.

3. Permitted use

You may use the service only for lawful internal business purposes, in accordance with Amazon’s agreements and policies. You may not probe or disrupt the service, bypass access controls, introduce malicious code, extract credentials, reverse engineer protected components, or use the platform to mislead Amazon or any third party.

4. Recommendations and changes

Software and AI-generated analyses are decision support, not guarantees of sales, ranking, profitability, or compliance. During the private beta, every material advertising change requires the connected business’s named owner approval before execution. The account owner remains responsible for budgets, content, claims, prices, inventory, and business decisions.

5. Fees

Munchello currently charges no subscription or authorization fee for approved private-beta access. Amazon advertising spend, seller-account fees, and third-party costs remain the connected business’s responsibility. If Munchello introduces fees, they will be documented in a separate written order before they apply.

6. Confidentiality and data

Each party will protect nonpublic information received from the other and use it only for the authorized service. Munchello’s processing of personal and Amazon account data is described in the Privacy Notice. A signed data-processing agreement, service authorization, and precise account/profile scope are mandatory before any production Amazon connection is activated; those documents control if they conflict with these public Terms.

7. Availability and suspension

The service is a private beta and may change. Munchello may suspend access to protect accounts, investigate suspected misuse, comply with Amazon or law, or address security and data-integrity risks. Amazon may change or withdraw API access independently of Munchello.

8. Disclaimers and liability

To the extent permitted by law, the beta service is provided “as is” and “as available,” without warranties of uninterrupted operation or particular commercial outcomes. Munchello is not Amazon and is not endorsed by Amazon. Nothing in these Terms excludes liability that cannot legally be excluded.

9. Termination

Either party may end private-beta participation. On termination, the account owner should revoke the Amazon authorization and may request deletion under the Data Deletion page. Terms that by their nature should survive—including confidentiality, ownership, disclaimers, and accrued obligations—will survive.

10. Ownership and license

Munchello retains ownership of the platform, software, documentation, and related intellectual property. Each approved business receives a limited, revocable, non-transferable right to use the private beta for its authorized internal operations. The connected business retains ownership of its content and account data.

11. General terms

These Terms are governed by Delaware law, without regard to conflict-of-law principles, except where applicable law requires otherwise. A party may not assign these Terms without the other party’s consent, except in a merger or sale of substantially all related assets. If any provision is unenforceable, the remainder stays effective. Delay in enforcement is not a waiver. The signed service authorization and data-processing agreement, together with these Terms and the Privacy Notice, form the agreement for private-beta use.

12. Contact and changes

Munchello may update these Terms as the service develops. Material changes will be communicated before they apply to active production users. Formal notices and questions may be sent to Munchello LLC at amazon-api@munchellollc.com.
